Welcome to nomadtrail.net. These Terms of Service (“Terms”) are a binding agreement between you and Nomad Trail Mongolia (“Nomad Trail”, “we”, “us”), the owner and operator of nomadtrail.net. By making a booking or using our services, you (“you”, “traveler”, “guest”) agree to these Terms.


1) Booking & Payment

1.1 How to Confirm

Most day tours and short trips require full payment at the time of booking.

Multi-day tours can be secured with a 30% deposit; the remaining balance is due no later than 14 days prior to the tour start date, unless payment on arrival has been specifically approved and stated in writing on your invoice.

Bookings made within 60 days of the tour start date require full payment at the time of booking.

Your booking is confirmed only after payment is received.


1.2 Payment methods

We accept credit/debit cards, PayPal, Stripe, and bank transfer. Prices are listed in USD unless stated otherwise. Your bank or card issuer may apply its own exchange rate and fees.


1.3 Confirmation

We’ll email a booking confirmation after successful payment. If you don’t receive it within 24 hours, please contact us.


2) Cancellations & Refunds

2.1 If you cancel

To secure participation in a tour, a 30% deposit is required at the time of booking.

This deposit is used to reserve availability and prepare services in advance. Third-party services such as accommodations, domestic flights, festival tickets, transportation, and local supplier services are typically confirmed approximately 60 days before departure, after which many services become non-refundable.

Cancellation fees are based on the following notice periods:

60+ days before arrival:
The 30% deposit may be refunded, less applicable payment processing fees and any confirmed non-refundable third-party costs already incurred.

30–59 days before arrival:
The 30% deposit becomes non-refundable. Up to 50% of the remaining balance paid may be refunded, minus confirmed non-refundable third-party costs and applicable payment processing fees.

Less than 30 days before arrival:
No refund will be issued.

No-show:
No refund will be issued.

Refunds, when applicable, are calculated based on:

  • Confirmed non-refundable third-party costs
  • Administrative and payment processing fees
  • Applicable cancellation period

The 30% deposit represents a reservation and administrative fee required to secure limited-availability services, and becomes non-refundable once third-party services have been confirmed (typically 60 days before departure).


2.2 If we cancel

If we cancel due to unforeseen circumstances (e.g., severe weather, safety concerns, government restrictions, or operational issues), you may choose:

  • A full refund
    OR
  • To reschedule your tour to another available departure date.

2.3 Force majeure

If extraordinary, unavoidable events (e.g., political instability, natural disasters, pandemics, border closures, or extreme weather) significantly affect the tour, either party may cancel.

In such cases, travelers are entitled to a refund of payments made, excluding non-refundable third-party costs already incurred.

This does not cover non-tour costs you booked independently (e.g., flights, visas, insurance).


2.4 Unused services & early departure

No refunds or credits are given for:

  • Unused services
  • Missed activities
  • Itinerary deviations chosen by the traveler

Any extra costs resulting from an early departure are your responsibility.

We will attempt to recover refundable amounts from third-party providers where possible, but this is not guaranteed.


2.5 Refund method & timing

Approved refunds are processed to the original payment method within 7–10 business days.

Bank or payment processor timelines are outside our control.


2.6 Chargebacks

If something isn’t right, please contact us first so we can help.

Initiating a chargeback without allowing us the opportunity to resolve the issue may delay your refund process.


2.7 Non-refundable third-party services

Certain services booked on behalf of travelers may be non-refundable once confirmed, including but not limited to:

  • Domestic flight tickets
  • Festival or event tickets
  • Special permits
  • Remote or seasonal accommodations
  • Limited-capacity transportation services

Any confirmed non-refundable third-party costs will be deducted from any applicable refund, regardless of cancellation timing.


2.8 Festival & Peak Season Tours

Tours that include major festivals or peak-season travel periods (including but not limited to Naadam Festival, Golden Eagle Festival, or similar events) may involve limited availability and prepaid services that require early confirmation.

For such tours:

  • Deposits follow the standard cancellation policy, including refund eligibility if cancellation occurs more than 60 days before departure, unless non-refundable third-party costs have already been incurred.
  • Certain services, including festival tickets, charter transportation, or special accommodations, may become non-refundable earlier than standard tours due to supplier requirements.
  • Any special cancellation conditions will be clearly stated on the relevant tour page, invoice, or booking confirmation.

3) Changes & Modifications

3.1 Changes by you

Minor itinerary changes may be requested up to 40 days before departure, subject to availability and any price differences.

Last-minute changes (less than 40 days) aren’t guaranteed and may incur extra costs.


3.2 Changes by us

We may adjust the itinerary due to weather, safety, local conditions, or similar reasons. We’ll offer a comparable alternative where feasible.


3.3 Transfers to another traveler

You may request to transfer your booking to another person who meets all participation requirements up to 7 days before departure; admin or third-party costs may apply.


4) Travel Insurance

4.1

We recommend purchasing comprehensive travel insurance that covers cancellations, medical emergencies, repatriation, and unforeseen incidents.

4.2

This insurance should also address potential delays, lost baggage, or other disruptions that could arise.


5) Eligibility, Minors & Conduct

5.1 Eligibility

You are responsible for ensuring you are legally able to travel and participate in the activities on your tour.


5.2 Minors

Guests under 18 years must be accompanied by a parent or guardian.

Some activities have minimum age or skill requirements.


5.3 Conduct

Respect local laws, cultural norms, wildlife, and guide instructions.

We may remove any participant whose behavior is unlawful, unsafe, or disruptive without refund.

Any resulting costs are the participant’s responsibility.


6) Health, Fitness & Safety

6.1 Medical disclosure

Please share any medical conditions, dietary needs, or mobility concerns when you make your booking.


6.2 Assumption of risk

Participation in activities requiring physical effort is at your own risk.


6.3 Right to refuse participation

Guides may decline participation in activities if safety could be compromised.


7) Third-Party Services

Certain tour components (e.g., accommodations, transportation, excursions) may be provided by independent third-party operators.


8) Visas, Passports & Entry

You are responsible for valid passports, visas, vaccinations, and complying with entry/exit rules.

We are not responsible if you are denied entry due to documentation issues.


9) Pricing, Inclusions & Exclusions

9.1 What’s included

Inclusions are listed on the specific tour page, itinerary, and invoice.


9.2 What’s not included

Unless stated otherwise:

  • International flights
  • Visas
  • Travel insurance
  • Personal expenses
  • Tips
  • Optional activities

10) Intellectual Property

All content, logos, images, and materials on our website and marketing channels are the property of Nomad Trail.

Unauthorized use is prohibited.


11) Liability & Consumer Rights

11.1 No indirect damages

We are not liable for indirect losses such as missed flights or lost profits.


11.2 Non-waivable rights

Nothing in these Terms limits rights protected under applicable consumer laws.


12) Privacy & Data Protection

Payment details are processed securely by third-party processors such as Stripe and PayPal.

13) Complaints & Support

If an issue occurs during your tour, notify your guide immediately.

If unresolved, email contact@nomadtrail.net within 14 days of your tour end date.


14) Governing Law & Disputes

These Terms are governed by the laws of Mongolia.

Disputes shall be resolved through mediation or the courts of Mongolia.

16) Updates to Terms

We reserve the right to update these Terms of Service at any time. Any changes will take effect when posted on this website with a revised “Last updated” date, unless otherwise stated.

Updated Terms apply to bookings made after the revised effective date. Bookings confirmed before that date remain governed by the Terms in effect at the time of booking, unless otherwise agreed in writing.
